Payment Regime Now in Effect for Manitoba's Construction Industry - Updates to the Manitoba Builders' Liens Act
April 1, 2025
After 13 years of dedicated advocacy, MCAM is pleased to announce that Manitobans now benefit from the protection of a Prompt Payment Regime for the construction industry. Effective April 1, all projects with a prime contract signed on or after this date will be subject to the new regulations.
Key updates to the Manitoba Builders' Liens Act (BLA) and its accompanying regulations define the prompt payment process:
- Owners must pay contractors within 28 days.
- Contractors must pay subcontractors within 7 days.
- An Adjudication Authority has been established to resolve disputes, with further details forthcoming.
- The Holdback period has been extended to 60 days for all contracts, regardless of when they were entered.
MCAM is proud the 13-year collaboration with construction industry partners has resulted in these critical changes.
"Timely adjudication of payment disputes is essential. Many contractors have gone out of business waiting months-or even years-for contract resolutions, often receiving only cents on the dollar. The implementation of a prompt payment regime is a much-needed safeguard for our industry."
- Brad Mason (SERVCO), Co-Chair of the now-dissolved Manitoba Prompt Payment Coalition (MBPP).
"This has been a long journey and a privilege to work alongside industry leaders. By advocating together, we are fostering a healthier construction industry in Manitoba."
- Norm Blerot (Blerot Masonry), past MBPP member.
"I credit both the current and previous governments for listening to and understanding industry needs. The MCAM Board of Directors dedicated the necessary resources to make Prompt Payment a reality."
- Ramona Coey, MCAM Executive Director and MBPP Co-Chair.
The Prompt Payment system will significantly improve cash flow and provide trade contractors with vital protection against delayed payments.
